  1. The Office of the Advocate for Children and Young People (‘ACYP’) and the NSW Youth Advisory Council, at their discretion, will determine whether your artwork entry (‘entry’) is to be considered.
  2. By submitting your entry, you and your parent/guardian(if you are under the age of 18) agree to be bound by these Terms and Conditions.
  3. ACYP will only consider entries from children and young people between ages 12 to 24.
  4. Only one entry will be accepted by each individual or group. This will be the first entry received by ACYP.
  5. Your age for eligibility assessment purposes will be your age as at the date your entry is received by ACYP.
  6. ACYP will not accept responsibility for entries not received by the closing date or for entries that are incorrectly completed. ACYP’s decision on submission timing and completeness is final.
  7. ACYP will consider entries from those who physically live in NSW, with a NSW mailing address only.
  8. All entries must be submitted online through ACYP’s website (link to competition link) with all supporting information or materials uploaded. Any physical information, applications or materials sent or delivered to the ACYP office will not be accepted, nor will ACYP be responsible for their return.
  9. When submitting an entry, you must provide your name, age, address, email and contact number. If under 18, you must also provide the name, email and contact number of your parent(s) or guardian.
  10. ACYP accepts no responsibility for any costs associated with creating the artwork. All entries should be created with items already accessible and available to you.
  11. If you are under 18 years old: 
    1. You must receive parental or guardian consent to make an entry.
    2. You must provide a valid phone number and email address of your parent/guardian so that ACYP may verify such consent.If you are under 18 years old:
    3. ACYP may contact your parent, guardian, or carer in relation to your entry.
    4. ACYP is not responsible for incorrect information submitted such as a phone number, email or mailing address.
  12. You must exclusively own all intellectual property rights in your entry. Proof of ownership may be required, and you agree to complete or provide all such documentation upon request to confirm such proof of ownership.
  13. Any use of Artificial Intelligence platforms to create the artwork will automatically disqualify your submission.
  14. By submitting your entry, you grant ACYP, whilst fully retaining your intellectual property rights to your entry, a world-wide, royalty-free licence, including a right to sub-licence, to enable ACYP and its sub-licensee(s), including third parties, to freely use your entry.
  15. ACYP will not disclose any of your personal information to a third party without your consent. However, if you are under 18 years old, ACYP may contact particular services or organisations in relation to your entry without your consent.
  16. Inappropriate entries including but not limited to those depicting nudity, violence, unsafe activities, substance abuse or misconduct will not be accepted, determination of which is at the sole discretion of ACYP.
  17. You or your parent/guardian indemnify ACYP on demand by ACYP in respect of all claims demands, liability, damages or causes of action (however named or described) losses, costs or expenses directly or indirectly incurred or suffered by ACYP in respect of the following:
    1. any infringement by you of any intellectual property rights of any other person in respect of your entry;
    2. making your entry;
    3. any injury or damage to you and your parent/guardian or any other person's computer relating to or resulting from participation in or downloading any materials in connection with making your entry;
    4. the use of your entries by the ACYP; and
    5. any breach of these Terms and Conditions.
  18. All entries are final and will not be returned to you.
  19. The prize is subject to availability. ACYP reserves the right to substitute alternative prizes of equivalent or greater value and to amend or foreclose the promotion without notice. No correspondence will be entered into regarding prize changes.
  20. The prize is non-exchangeable, non-transferable and is not redeemable for cash or any other prizes.
  21. Winners (and their parent(s)/guardian, if under 18) will be notified by email and phone call. For group entries, the email used for submission of your artwork will be notified.
  22. The winners and their submissions will be announced on ACYP and NSW Youth Week social media accounts from April 16, 2025.
  23. ACYP accepts no responsibility for any costs associated with the Prize that may be incurred by the winner.
  24. ACYP will not be responsible for any failure in prize delivery due to an incorrect address or email nominated by the winner, or for any late, lost or misdirected deliveries or mail.
  25. ACYP reserves the right to modify or discontinue the acceptance of entries at any time, with or without prior notice, for reasons outside its control (including anticipated, suspected, or actual fraud). ACYP’s decision in all matters under its control is final and binding.
  26. ACYP reserves the right to change the opening and closing dates/times or to accept late entries, at their sole discretion. ACYP’s decision in this regard will be final.
  27. ACYP shall not be liable for any failure to comply with its obligations due to circumstances beyond its reasonable control, including but not limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
  28. These Terms and Conditions are governed by the laws of New South Wales. ACYP and the participants submit to the exclusive jurisdiction of the courts of that State.
  29. ACYP will determine at its discretion the appropriate time and manner for publishing the entries. This may include but is not limited to publishing the winning entries on social media and inclusion in the annual report.
  30. ACYP collects personal information in order to use your submission in relation to the Work, and to improve its services. Providing personal information is voluntary but if you decline to provide your personal information you will not be eligible to make your submission. ACYP is bound by the Privacy and Personal Information Protection Act 1998 (NSW). Your personal information is held by ACYP. You have the right to access and correct the personal information that ACYP holds about you. If you would like to access or update your personal information, please contact us by emailing acyp@acyp.nsw.gov.au.
  31. By submitting your entry, you agree that ACYP may use/ reproduce your artwork for promotional purposes, including but not limited to advertising, social media campaigns, and future competitions. ACYP may request further permissions from you for specific promotional users, but your participation in the competition grants ACYP broad usage rights as outlined in these terms, however we will only use the artwork as permitted under this agreement.
  32. ACYP reserves the right to disqualify any entry if it is found to be in violation of any competition rules, including but not limited to intellectual property infringement, submitting false information, or submitting inappropriate content as outlined in clause 15.
  33. ACYP reserves the right to modify or alter your entry for display or publication purposes (resizing, cropping or editing) but will not alter the core creative content or the original message of the artwork without your permission.
  34. ACYP reserves the right to amend, update, or change these Terms and Conditions at any time, including deadlines or eligibility requirements. Any such changes will be communicated on the official competition website or through email notifications to participants.
  35. Participation in the competition does not grant exclusive rights to ACYP over the artwork beyond the terms provided. You may continue to display, distribute, or sell your artwork independently of the competition, as long as it does not conflict with the usage rights granted to ACYP.
  36. By entering, you acknowledge that ACYP may feature you and/or your artwork in online platforms such as social media and the annual report, as part of the competition’s promotion.
  37. Your name will be credited where your artwork is used.
  38. The decision of the winner is final, and no correspondence regarding results will be entertained. Entries will be judged based on criteria set by ACYP. 38. Parent(s)/guardians for children under the age of 18, by consenting to their child’s participation, agree to these Terms and Conditions and confirms they have reviewed and approved the entry before submission.
  39. Any disputes arising in connection with the competition will be handled internally by ACYP.
